January (Location: Chatham County Sheriff’s Office) (For Sheriffs Only) “2025 – Overview of CPTS Training for your Staff” 10:00 a.m. to 4:00 p.m. approximately Description: This overview will inform Sheriffs about key CPTS instructional goals for your staff (plus a Sheriffs’ overview of various civil papers, terminology, etc.). Emphasis will be on high-liability processes, risk avoidance strategies, costly missteps, common errors, civil process urban legends, enduring statutory mysteries plus Kevin’s unsolicited editorials.
February 12 (Location: New Hanover County Sheriff’s Office) ¾ Real Estate Basics for Civil Process and Child Custody Interventions 9:00 a.m. to 4:00 p.m. approximately Real Estate Basics for Civil Process and Patrol (morning) – This presentation provides an overview of eviction law basics, procedure, terminology, key concepts from G.S. 42-36.2 (“the Sheriff’s statute”), eviction jurisdiction, commercial evictions, frequently encountered eviction problems; “eviction and bankruptcy relief”; The Vacation Rental Act; Trespass or eviction? patrol response difficulties, including, “How to determine whether the parties are actually in a lease agreement?” Full Q&A—plus skill-set scenario discussions. Child Custody Interventions (afternoon) – This presentation discusses the proper role of law enforcement response in child custody disputes (typically arising from 911 calls): 50A-311 warrants, Senate Bill 53, discussion of so-called “ex parte” (stand alone) orders; ‘non-court-order’ situations (e.g., babysitters, grandparents, alleged “kidnappings”); jurisdiction and “fax/scan orders” confusion; brief chat on SROs and parent-school “child pick-up” disruptions (as based on the above principles); skill-set scenario discussions.
March 19 (Location: Cabarrus County Sheriff’s Office) –Overview of Writs of Execution 9:00 a.m. to 4:00 p.m. approximately Description: Statutes, procedures, decision-making, risk management, exemptions, identification of proper debtor assets, bankruptcy, fraudulent conveyances, real estate sales, use of force, so-called “bank levies,” and additional topics. April TBA (Location: Orange County Sheriff’s Office) – Service of Process Fundamentals 10:00 a.m. to 2:30 approximately Description: This presentation focuses on legal essentials for basic service of process. Focus is on “Rule 4” of the N.C. Rules of Civil Procedure, which is the statute that governs what courts consider legally valid “service by the Sheriff” (N.C. Gen. Stat. 1A-1). Civil summonses are the central topic, but the service principals apply to many other civil papers equally. Civil summons emphasis is on proper identification of defendant legal “categories,” including an overview of ‘natural person’ defendants, plus sole proprietorships, corporations, partnerships, limited partnerships, Limited Liability Companies, Limited Liability Partnerships (and such related terminology as “d/b/a/, t/a/, Ltd., Company, Co., Inc. LLC, PLLC, PC, PA,” etc.) and service requirements for each. Discussion includes basic risk management concepts, negligence as regards failure to achieve proper service, and risk-management strategies to protect the Sheriff.
May (Location: Caldwell County Sheriff’s Office / Tentatively) – Civil Process Fundamentals for Patrol Sergeants 9:00 a.m. to 4:00 p.m. approximately Description: This course will address common patrol situations for which officers may encounter uncertainty with “civil law” and “civil process” law. Among the topics: Eviction basics (including the phenomenon of so-called “911 eviction” calls) Trespass vs. eviction dilemmas (“which course of action is appropriate?”) Involuntary Commitment (a few modern observations and concerns) Basic Service of Process — Understanding Rule 4 "Writs of Possession for Personal Property" — Patrol staff, beware! "Claim & Delivery” — (what exactly is this? Why should patrol be careful recommending this process to citizens?) Repossession confrontations (“What is the role of 911 patrol?”) Child Custody — with court orders, without court orders, 50A Warrants, and a dash of Chapter 7B OTHER TOPICS as participants may raise through Question & Answer Sessions).
June 20 (Day & Location: Dare County Sheriff’s Office / Tentatively) – Understanding Prejudgment Remedies 9:00 a.m. to 3:00 p.m. approximately Description - This presentation provides an overview of the “prejudgment” processes known as Attachment, Garnishment, and Claim & Delivery. Class lecture will develop a sense for commercial contracts “gone wrong,” focusing on the Sheriff’s court-ordered role in levying and protecting assets in advance of litigation. This is a high-liability topic. We will (1.) Survey and become familiar with applicable General Statutes, AOC forms, and court orders directed to the Sheriff; (2.) Develop basic management and problem-solving skills; (3.)Learn simple strategies to limit liability and protect the Office of Sheriff.
